As a Music
Clearance Consultant, I play a crucial behind-the-scenes role in the
entertainment industry for music, film, advertising and video games.
I understand
the legal landscape around adaptation rights, which are required when
someone wants to create a derivative work based on an existing song.
My main job is to secure the legal rights to use music in various media projects.
I can represent the owners and the users of music.
Here is a breakdown of what I do:
1.
Identifying Copyrighted Material:
I determine which songs, quotes or recordings require clearance and which are
in the public domain.
2. Determination of the Type of Music Derivative: How exactly do you want to use this music?
After communicating with you, I qualify the type of way you want to use the music to know if it is a sample, cover, interpolation, synchronisation, remix, etc.
My questions will help determine my negotiations on your behalf with the music rights holders.
3. Researching Rights Holders: How many people own this song that you want to use?
This involves tracking down
who owns the rights to a piece of music, whether it is a record label,
publisher or an artist’s estate.
4.
Negotiating Licenses: I contact
rights holders to negotiate terms, fees and usage rights for the music.
5.
Reviewing of Contracts: I ensure
all legal agreements are accurate and protect the interests of the production
company or client.
6.
Ensuring Compliance: I make
sure all music used is properly licensed to avoid legal issues or copyright
infringement.
7.
Collaborating with Creatives:
I work closely with music supervisors, producers and legal teams to align music
choices with creative goals and budget constraints.
In essence, I am the bridge between
creativity and legality by making sure the perfect song can be used without
stepping on any legal landmines.
8. Registering
of Derivative Work and New Songs
I help to register a derivative work, like filing it with a copyright office or a performance right, so that there will be no confusion between your version, the original song and other versions of the song.
I can also register new songs on
your behalf.
